Releasor specifically and expressly acknowledges that he or she will be participating in the Official Art Deco Guided Walking Tour, which is being conducted and coordinated by MDPL. Releasor, on behalf of himself or herself, his or her personal representative, heirs, next-of-kind, successors and assigns, all herin after referred to as “Releasor”, hold harmless the City of Miami Beach and MDPL, and their respective successors, assigns, servants, officers, employees, elected and appointed officials, all herein referred to as “Releasees”, from any and all claims, actions, demands or damages, including but not limited to, accidents, injury, death or damages to his or her person or property, arising or resulting from his or her participation in the MDPL tour. Releasor’s obligation shall not include the obligation to indemnify Releasees from and against any actions or claims which arise or alleged to have arisen from gross negligent acts, or other wrongful intentional conduct of Releasees and their officers, employees and agents. Releasor expressly agrees that this Agreement is intended to be as broad and inclusive as permitted by the laws of the State of Florida and that, if any portion thereof is held invalid, it is agreed that the balance shall, not withstanding, continue in full legal force and effect.Releasor further releases Releasees from any claim whatsoever on account of first aid, treatment or services rendered to him or her during his/her participation in the aforestated activities/event.This Release contains the entire agreement between the parties hereto and the terms of this Release are contractual and not a mere recital.
RELEASOR FURTHER STATES THAT HE/SHE HAS CAREFULLY READ THIS AGREEMENT AND SIGNS THIS RELEASE AS HIS/HER OWN FREE AND VOLUNTARY ACT.
